I participated in a Private Party transfer without going through a dealer. What do I do? |

In general, all firearm transfers within the borders of California, even private party transfers (transfers between two parties where neither party is a licensed firearms dealer under federal, state and local laws), must be conducted through a Licensed Firearms dealer. This means that the buyer must give the firearm to a Licensed Firearms Dealer and that dealer can then sell the firearm to the buyer. Dealers may charge a fee for this transaction.
If you have purchased a firearm through a Private Party transfer without conducting the sale through a Licensed Firearms Dealer, the California Department of Justice, Firearms Division has stated in a July 14, 2003 reply letter requested by Trutanich - Michel, LLP that they do not prosecute persons that attempt to correct this violation by properly filling out and filing a Voluntary Registration Form. |
