If I own a firearm defined by state law to be an "assault weapon", can I modify it so that it no longer falls under the definitions? PDF Print E-mail

Yes, providing it is defined as an "assault weapon" under the "generic" definitions contained in Penal Code section 12276.1. You can simply remove the listed characteristics that would place it in the "assault weapon" category (i.e. flash suppressor, thumbhole stock, etc.). However, if your firearm is defined in section 12276, it cannot be modified to take it off the "assault weapon" list. This is because section 12276 lists affected firearms by make and model without regard to the presence or absence of specific characteristics.
